By accessing, downloading, or using the PickCup application (the "App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and Janiv & Liran Ratson (PickCup) ("we," "our," or "us").
PickCup is a free-to-play social guessing game. It is NOT a gambling, wagering, or betting service of any kind.
No real money is wagered, deposited, or staked at any time. There are no entry fees, purchase requirements, or payments of any kind required to participate. Points, scores, and leaderboard positions earned within the App have no monetary value whatsoever, cannot be redeemed for cash, prizes, gift cards, cryptocurrency, or any item of real-world value, and cannot be transferred, traded, or sold to other users. The App is strictly for entertainment, social competition, and bragging rights among friends.
We reserve the right to modify the point system, reset leaderboards, or adjust scoring mechanics at any time and without prior notice. Points and scores do not constitute property, a stored value, or any form of asset.
Apple Inc., Google LLC, and Microsoft Corporation are not sponsors of, nor are they responsible for or involved in any way with, the predictions, leaderboards, squads, or contests presented within this App. Any questions, complaints, or claims regarding the App should be directed to Janiv & Liran Ratson (PickCup), not to the platform providers.
You must be at least 13 years of age to create an account and use PickCup. By using the App, you represent and warrant that you meet this age requirement. If we discover that a user is under 13, we will terminate their account and delete their data promptly.
You are responsible for ensuring that your use of the App complies with all laws and regulations applicable to you in your jurisdiction. If social guessing or prediction games are restricted or prohibited in your region, you must not use the App.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree not to:
Use the App for any unlawful purpose; impersonate another person or entity; harass, abuse, or threaten other users within squads or elsewhere in the App; attempt to manipulate leaderboards, scores, or predictions through automated scripts, bots, multiple accounts, or any other form of cheating; reverse-engineer, decompile, or disassemble any part of the App; or use the App in any way that could damage, disable, or impair our servers or infrastructure.
We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates these rules, including removal of content, suspension, or permanent termination of accounts.
PickCup allows users to form squads and create content such as display names, squad names, and profile images. We maintain a zero-tolerance policy for objectionable content or abusive behaviour. You agree not to post, upload, or share any content that is offensive, discriminatory, sexually explicit, threatening, harassing, or illegal.
We provide in-app features to flag or report objectionable content and to block abusive users. We reserve the right to review, remove, or disable any user-generated content and to suspend or permanently ban any user within 24 hours of a report, at our sole discretion and without prior notice.
All content, branding, trademarks, UI designs, graphics, and software within the App are the property of Janiv & Liran Ratson (PickCup) or its licensors and are protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App or its content, nor may you reverse-engineer or attempt to extract the source code, except where applicable law expressly permits.
You retain ownership of any content you submit to the App (e.g., display names, profile photos). By submitting content, you grant us a worldwide, royalty-free, non-exclusive license to use, display, and distribute that content solely in connection with operating and improving the App.
The App may display sports fixtures, scores, and related data sourced from third-party providers. We do not guarantee the accuracy, completeness, or timeliness of this data. Discrepancies in sports data do not entitle you to any compensation, as no real-world value is at stake.
We reserve the right to suspend or terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms or engaged in abusive, fraudulent, or disruptive behaviour. You may also delete your account at any time through the App (see our Privacy Policy for details on data deletion).
Upon termination, your right to use the App ceases immediately. Sections that by their nature should survive termination (including Limitation of Liability, Indemnification, and Governing Law) will remain in effect.
The App is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
To the maximum extent permitted by applicable law, Janiv & Liran Ratson (PickCup) and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of data, loss of profits, or loss of goodwill — arising out of or in connection with your use of the App, regardless of the theory of liability.
Our total aggregate liability to you for any claims arising under these Terms shall not exceed the amount you have paid us in the twelve (12) months preceding the claim — which, given that the App is free, is zero.
You agree to indemnify, defend, and hold harmless Janiv & Liran Ratson (PickCup) and its affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any rights of a third party.
These Terms shall be governed by and construed in accordance with the laws of the State of Israel, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the competent courts located in Tel Aviv-Jaffa, Israel.
Nothing in this section limits your rights under mandatory consumer protection laws in your jurisdiction of residence.
We may revise these Terms at any time. If we make material changes, we will provide notice through the App or via the email address associated with your account at least 14 days before the changes take effect. Your continued use of the App after the revised Terms become effective constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the App and delete your account.
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible, and the remaining provisions will continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Janiv & Liran Ratson (PickCup) regarding your use of the App, and supersede all prior agreements, understandings, and communications.
